Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you ("you," "User," or "Contractor") and Stratara Corporation ("Company," "we," "us," or "our"), the operator of Gablr at https://gablr.ai ("Service").

By accessing or using the Service, creating an account, or clicking "I Agree," you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, do not access or use the Service.

You must be at least 18 years of age and legally authorized to enter contracts in your jurisdiction to use this Service. By using the Service, you represent that you meet these requirements. The Service is not intended for use by individuals under 18 years of age.

Gablr is a software-as-a-service (SaaS) platform that uses artificial intelligence, satellite imagery, and regional pricing data to generate roofing cost estimates ("Estimates") for properties in the United States.

To access certain features you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and accept responsibility for all activity under your account.
• Notify us immediately at help@gablr.ai of any unauthorized use of your account.
• Not share your account credentials with third parties.

We reserve the right to terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used fraudulently or abusively.

You acknowledge and agree to all of the following:

• Not Professional Advice: Estimates generated by Gablr are not the opinion of a licensed contractor, engineer, architect, or insurance professional. Nothing in the Service constitutes professional advice of any kind.
• Accuracy: AI-generated measurements and pricing are estimates only. Satellite imagery resolution, roof complexity, local labor markets, material costs, and weather conditions can cause significant variation from actual project costs.
• No Insurance Use: You agree not to submit Gablr estimates to any insurance company as a professional damage assessment or to support an insurance claim without independent professional verification.
• No Guarantee: The Company makes no representations that any estimate accurately reflects the actual cost of any roofing project.
• Your Responsibility: You are solely responsible for verifying estimates with licensed professionals and for all decisions made in reliance on Gablr output.
• FTC Disclosure: Estimates are generated using artificial intelligence technology including large language models and computer vision systems. AI-generated content may contain errors or omissions.

You agree NOT to use the Service to:

• Submit estimates to insurance companies or adjusters as professional assessments.
• Misrepresent AI-generated estimates as the opinion of a licensed contractor.
• Engage in insurance fraud or any fraudulent activity.
• Resell, sublicense, or redistribute estimates or Service output for commercial purposes beyond your own business use.
• Reverse-engineer or attempt to extract AI models, training data, or proprietary algorithms.
• Send automated requests that overload our systems.
• Violate any applicable law, regulation, or third-party right.
• Impersonate any person or entity or misrepresent your affiliation.

Violation of this policy may result in immediate account termination and, where applicable, legal action.

The Service integrates with the following third-party services. Your use of the Service constitutes acknowledgment of their terms:

• Stripe — payment processing (stripe.com/legal)
• Supabase — database and authentication (supabase.com/terms)
• Google Maps, Solar, and Street View APIs — property imagery and location data (Google Maps Platform Terms)
• OpenAI / Google Gemini — AI analysis of roofing data
• Resend — transactional email delivery

We are not responsible for the availability, accuracy, or practices of any third-party service.

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and share information. By using the Service, you consent to our data practices as described in the Privacy Policy.

We may suspend or terminate your account and access to the Service at any time, with or without cause, upon notice. Grounds for termination include but are not limited to: violation of these Terms, fraudulent use, non-payment, or abuse of the Service.

Upon termination, your right to use the Service ceases immediately. Sections 5, 7, 11, 12, 13, and 14 survive termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) ESTIMATES WILL BE ACCURATE OR RELIABLE; (C) THE SERVICE WILL BE ERROR-FREE; OR (D) ANY ERRORS WILL BE CORRECTED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STRATARA CORPORATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: LOST PROFITS, LOST REVENUE, COST OF SUBSTITUTE SERVICES, PROPERTY DAMAGE, OR LOSSES ARISING FROM RELIANCE ON AI-GENERATED ESTIMATES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the minimum extent permitted by law.

You agree to defend, indemnify, and hold harmless Stratara Corporation and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) your use of any Estimate in connection with an insurance claim or contractor bid without independent professional verification.

We may update these Terms at any time. We will notify active subscribers of material changes by email at least 14 days before they take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Stratara Corporation regarding the Service.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.

No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
